Version 2 · Updated
The rest of this page says the same things in full. If you use Dizzy, these terms apply to you.
Dizzy is run by Harry Hartley, a sole trader based in the United Kingdom. When these terms say “we” or “us”, they mean him.
To contact us about anything on this page, email privacy@dizzy.gg.

A postal address for legal notices is being set up and will be shown here. Until then, send every notice to privacy@dizzy.gg.
These terms are an agreement between you and us. Our privacy notice is separate. It says what data we hold about you and what your rights are.
Anyone can read Dizzy, at any age, without an account.
To make an account, you must be 13 or over. This is how we apply that rule:
If you think an account belongs to someone under 13, tell us at privacy@dizzy.gg. A parent or guardian can write to us too.
Players aged 13 to 17 are welcome on Dizzy. A player can count as under 18 in two ways:
While you count as under 18, we keep your name off the public list of who is coming to an event, and out of a bracket until it starts. We never say in public that you are under 18. The privacy notice says exactly what changes and who can see it.
You can change your own answer at any time. Only a moderator can take off a mark a host or a moderator put on. If you think a mark is wrong, or you were wrongly treated as under 18 or under 13, email privacy@dizzy.gg. We deal with it as a complaint (see Complaints and appeals).
Not everyone can post everything. This is who can put what on Dizzy:
Hosts and organisers are responsible for their own event pages, their announcements, and the names they type in for other people. When you add a player at the door, enter the name they play under, never their real name. Check with a parent or guardian before you add a player under 13.
Only upload things you made or have the right to use (see Copyright).
These rules apply to every name, prefix, pronoun, picture, description, announcement, replay and link on Dizzy:
Some content is harmful, especially to children. Each kind below is not allowed on any part of Dizzy, for any user, whatever their age. That includes pictures, names, descriptions, announcements, replays and links to it.
These rules are the same for everyone. They do not change with your age.
Nothing illegal is allowed on Dizzy. We name three kinds on their own, because the law treats them separately:
We protect people from this content in four ways:
We do not use any automated tools (“proactive technology”) to scan pictures or posts for illegal or harmful content. The one automatic check we run blocks a short list of slurs from web addresses and team names. If we ever add a tool that scans content, we will say here what it does, when it runs and how it works, before we switch it on.
When Dizzy's Discord bot has already posted a picture into a Discord server, that copy is on Discord. Removing it from Dizzy does not remove it there, so report it to Discord as well.
To report content, email privacy@dizzy.gg. You do not need a Dizzy account, and a parent, guardian or anyone else can report too. Tell us:
We read every report. We look at reports of illegal content, and of content that could harm children, first and as quickly as we can. We aim to deal with every other report within 14 days.

A report button beside each player, event, community and picture is being built. Until it is ready, email works for every kind of report.
If an intimate image of you is on Dizzy without your consent, or you are reporting one for the person in it, email privacy@dizzy.gg with “Intimate image report” as the subject. We deal with these before anything else. Your report needs to say:
Once we have a report with all of this, we take the image down, and any copy of it we find on Dizzy, within 48 hours. The only exceptions are if we decide it is not an intimate image, or that the person reporting it is not the person in it or acting for them. If you disagree with what we decide, you can complain, and we deal with your complaint before any other.
You can complain to us about any of these. Email privacy@dizzy.gg and say which it is:
This is what happens next:
If an automated tool ever takes down your content and you think it broke these terms in doing so, you also have the right to take us to court for breaking our agreement with you.
Complaints about how we use your personal data are covered in the privacy notice.
Depending on what happened and how serious it is, we can:
We usually tell you what we did and why, unless the law stops us or telling you would put someone at risk. You can appeal (see Complaints and appeals).
What you upload to Dizzy stays yours. By uploading it, you give us permission to store it, copy it, resize it, convert it, and show it to anyone on Dizzy, in the Dizzy app, through Dizzy's Discord bot and through Dizzy's API, for free and anywhere in the world. That permission lasts while it is on Dizzy, and ends when it is removed, apart from backup copies, which we delete within 90 days.
You promise that you made what you upload, or that you have the right to let us use it this way.
If you think something on Dizzy breaks your copyright, email a notice to privacy@dizzy.gg. Your notice needs:
If you are in the United States, you can also send a notice to our designated agent under the US Digital Millennium Copyright Act:
When we get a complete notice, we take the content down quickly and tell the person who uploaded it.
If you think it was taken down by mistake, email a counter-notice to privacy@dizzy.gg. It needs:
We send your counter-notice to the person who sent the notice. Unless they tell us they have started a court case to keep it down, we put the content back between 10 and 14 working days after we got your counter-notice.
If we uphold copyright notices against the same person three times, we take away their ability to upload and may close their account. We can act sooner for a serious case.
Dizzy is a record of competitive play. Results, brackets, ratings, rankings, placements and who attended an event are public, and anyone can see them, including search engines. Many results come from start.gg, Parry.gg and Challonge.
Results stay, because your opponents' results are their record too. You can ask us to take your name, tag and picture off them. The privacy notice explains what we keep, why, and how to ask.
Ratings and rankings are worked out by us from the results we have. They can change as more results come in, and they are not a promise about anyone's skill.
Events on Dizzy are run by their hosts, not by us. The host decides how the event runs and is responsible for it, including keeping people safe at the venue.
When you pay an entry fee, you pay the host, through the host's own Stripe account. We are not the seller, we take no share of the fee, and we are not part of the agreement between you and the host. Refunds, and any problem with the event itself, are for the host to sort out with you, under Stripe's rules and the law. Stripe collects your card details on its own page; we never see them.
Dizzy is free to use, apart from Premium. We work hard to keep it running and accurate, but we may change, add or remove features, and Dizzy may sometimes be unavailable. Results imported from other sites can have mistakes in them. If you spot one, tell us and we will fix it.
If we break these terms or do not take reasonable care, we are responsible for loss or damage you suffer that was a foreseeable result. Loss is foreseeable if it was obvious it would happen, or if we both knew it might when you started using Dizzy.
We do not limit our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. Nothing in these terms takes away your legal rights as a consumer, including your rights under the Consumer Rights Act 2015. If something we supply digitally damages your device or other digital content because we did not take reasonable care, we will repair the damage or pay you compensation.
We are not responsible for:
You can stop using Dizzy and delete your account at any time. If you have Premium, cancel it first so it does not renew.
We can stop you using Dizzy, or part of it, if you seriously or repeatedly break these terms, or if the law requires it. We will tell you why, unless the law stops us or it would put someone at risk, and you can appeal.
These terms are governed by the law of England and Wales, and you can bring a claim in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your own courts, under your own law. If you live in another country, you keep any protection the law of your country gives you as a consumer that cannot be taken away by an agreement.
The version number and date at the top of this page change whenever these terms do. If a change matters to you, we will say so on Dizzy before it applies. The next time you sign in, you will be asked to agree to the new version.
